Section 64
(1)
In the case of a private higher educational institution, upon approval of an application under section 60, the successful applicant is required to register and incorporate a limited company in accordance with the requirements of the Companies Act (Chapter 39) whose main purpose listed in its memorandum and articles of association is the establishment and management of the higher educational institution.
(2)
The Minister may prescribe minimum requirements and other related matters for the company to comply with and these requirements and matters are to be incorporated into the company’s proposed memorandum of association.
