Section 61
The Minister may refuse an application to establish a private educational institution unless he is satisfied that —
(a)
the applicant is capable of providing adequate educational facilities;
(b)
the applicant is capable of providing adequate and efficient management and administration for the operation of the institution;

(c)
adequate measures have been taken to ensure and maintain the prescribed standards of education;
(d)
a proper administration system and an instrument of government of the intended higher educational institution has been prepared for the approval of the Registrar General; and
(e)
the applicant or any of his partners or any member of the board of governors has not been convicted of any offence involving fraud or dishonesty and has never been adjudged bankrupt.
