Section 40
(1)
Any person aggrieved by any act done by or on behalf of the Government under section 36 may appeal to the High Court which may make such order as it thinks fit.

(a)
the Government; and
(b)
with the leave of the High Court, any other person, is entitled to appear and to be heard.
