Women and Girls Protection (Place of Safety) Rules, 2001
Opening note
Citation.
These Rules may be cited as the Women and Girls Protection (Place of Safety)
In these Rules unless the context otherwise requires
"Discharge Committee" means the body of persons appointed by the Minister under section 24;
"Medical Officer" means the person appointed by the Director General of
Medical Services as Medical Officer of any place of safety;
"Penal Grade" means the lowest grade in the grading system for the women and girls in the place of safety;
"staff" means any officer working in, or in a post connected with, a place of safety;
"Superintendent" means the officer appointed by His Majesty the Sultan and
Yang Di-Pertuan as Superinte~dent of any place of safety;
"Warden" means the female officer appointed by His Majesty the Sultan and
Yang Di-Pertuan as Warden of a place of safety.
Administration.
A place of safety shall be under the general charge and administration of a Warden, who shall be subject to and comply with such directions as may be given to her by the Superintendent.

His Majesty the Sultan and Yang Di-Pertuan shall appoint for a place of safety a Warden, female Assistant Wardens and other female staff as may be necessary.
Accommodation.
A room or dormitory shall not be used for the confinement of women and girls, unless it is certified by the Superintendent, on the advice of a Medical
Officer, to be lit, ventilated and equipped in such a manner, and to be of such size as may be requisite for health.
The certificate shall specify the maximum number of women or girls to be located at any one time in such room or dormitory. In special circumstances, with the authority of the Superintendent, the women and girls may be located in tents.
Accommodation by night.
Women and girls may be accommodated at night in rooms or dormitories with less than three women or girls in each room or dormitory. Each woman or girl shall be provided with a separate bed.
Place for sick women and girls.
Sufficient accommodation for the reception, accommodation and treatment of sick women and girls shall be provided. It shall be secured by locks, of which the keys shall be under the exclusive control of the officers of the place of safety.
Admission and search of women and girls.
The Superintendent shall, upon receiving a detention order, make all necessary arrangements for the conveyance of the woman or a girl named therein to the place of safety.
The woman or girl shall be searched on admission and at such times subsequently as may be directed, and all unauthorised articles shall be taken from her.

The searching of a woman or girl shall be conducted in a seemly manner so as to be consistent with the necessity of discovering any concealed article that could cause a danger to herself or any other person.
No woman or girl shall be searched under this rule except by a woman.
Women's and girls' property.
All money, clothing, documents or other effects belonging to a woman or girl which she is not allowed to retain shall be placed in the custody of the Warden, who shall keep an inventory thereof, which shall be signed by the woman or girl.
Particulars of woman or girl.
On admission, and from time to time as may be required, a woman or girl shall be photographed and her name, age, height, weight, distinguishing marks and other measurements and particulars shall be recorded in such a manner as may be directed.
Medical examination on admission.
A woman or girl shall, on the day of her reception or as soon as possible thereafter, be examined by the Medical Officer.
Bath on reception.
A woman or girl shall be given a bath on the day of her reception, unless the
Warden or Medical Officer otherwise directs.
Disease on admission.
If a woman or girl is found to have any infectious or contagious disease or to be in a verminous condition, steps shall at once be taken to treat the condition and to prevent it from spreading to other women and girls.
Notification of rules.
The Warden shall see a woman or girl on reception and explain to her the rules of the place of safety.
Medical examination before transfer or discharge.
A woman or girl shall be examined by the Medical Officer before being discharged or removed to another place of safety. No woman or girl shall be 1092
removed to any other place of safety unless the Medical Officer certifies that she is fit for removal. No woman or girl who is suffering from any acute or serious illness shall be discharged from the place of safety unless the Medical Officer thinks it is safe to do so or the woman or girl refuses to stay after the expiry of her period of detention.
Privacy during transfer.
A woman or girl shall be exposed as little as possible to public view while being removed from, or taken to, a place of safety.
Custody outside place of safety.
A woman or girl, who is required to be produced at a particular place by an order, shall be deemed to be in the lawful custody of the officers directed to convey her to that place.
Children.
Subject to such conditions as the Superintendent may determine, an infant child and a girl below the age of eighteen years may be received into a place of safety with its or her mother, and may be supplied with clothing and necessaries at the Government expense.
Possession.
No woman or girl shall have in her possession any prohibited article that the
Superintendent may specify. Any such article which may be found in her possession shall be confiscated by the Warden.
Conveyance of prohibited articles.
No person shall, without authority, convey or throw into, or deposit in, a place of safety, or convey or throw out of a place of safety, or convey to any woman and girl of a place of safety, or deposit with a view to its coming into possession of any such woman or girl, any prohibited article. Anything so conveyed, deposited or thrown without authority may be confiscated by the
Warden.

Search on entering or leaving.
Any person or vehicle entering or leaving a place of safety may be examined and searched. Any person suspected of bringing any prohibited article into the place of safety, or of carrying out any prohibited article or any property belonging to the place of safety, shall be stopped and immediate notice thereof shall be given to the Warden.
Liquor.
No woman or girl shall be given or allowed to have any intoxicating liquor.
Tobacco.
No woman or girl shall be allowed to smoke, or to have in her possession any tobacco, except in accordance with such orders as may be given by the Warden.

CLOTHING AND BEDDING
Clothing outftt.
A woman or a girl shall be provided with an outfit of clothing adequate for warmth and health in accordance with a scale approved by the Superintendent.
Provided, however, other clothing may be worn in special circumstances with the authority of the Warden or if recommended by the Medical Officer.
Bedding scale.
A woman or girl shall be supplied with adequate bedding for warmth and health in accordance with a scale approved by the Superintendent. Additional bedding may be authorised in special circumstances if recommended by the
Medical Officer.
Excess prohibited.
Subject to rules 23 and 24, no woman or girl shall, without the authority of the Warden, receive or have in her possession any clothing or bedding beyond the authorised amount.

Diet.
A woman or a girl shall be supplied with food in accordance with such dietary scales as the Medical Officer may determine.
Extra food.
A woman or girl shall not receive or have in her possession any food beyond the dietary scales, except -
{a}
with the authority of the Superintendent; or
{b}
with the authority of the Medical Officer, if a variation of diet is desirable on medical grounds.
Complaints about food.
A woman or girl who has any complaint to make regarding food supplied to her must make it as soon as possible after the food is served.
Washing and bathing.
A woman or girl shall obey such directions as may from time to time be given as regards washing and bathing.
Hair cutting.
A woman's or girl's hair shall not be cut without her consent, unless it is verminous or dirty, or when the Medical Officer deems it requisite on health grounds.
General cleanliness.
A woman or girl shall keep her room clean and neatly arranged as may be directed.

Exercise.
A woman or gir1 1 unless excused by the Medical Officer on medical grounds1
shall exercise regularly at physical drill as may be directed.
Work.
( 1)
A woman or girl 1 unless excused by the Medical Offi.cer on medical grounds1 shall perform any work as instructed at the place of safety and shall be taught 1 as far as possible1 useful tasks which may help her earn her livelihood on her discharge.
A woman or girl who has not been excused by the Medical Offi.cer shall be required to work at least 35 hours a week.
The Warden of a place of safety may introduce a scheme approved by the
Superintendent under which the women and girls may receive payment for work done.
Holidays.
Arrangements shall be made for the avoidance of all unnecessary work on one day in each weeki as the Superintendent may direct 1 and on all public holidays.
Religious functions.
Adequate arrangements shall be made to provide Islamic religious functions or teachings for the women and girls who profess the Islamic religion.
Religious books.
A woman or girl sha11 1 from the beginning of her stay at the place of safety be furnished with such religious books1 as may be available.

Classes.
Educational classes shall be provided for the benefit of all women and girls.
Library books.
A library for the use of the women and girls shall be provided in a place of safety. A woman or girl shall be allowed to have not more than three library books in her room at the same time.
Letters and visitors.
( 1)
Communications between a woman or girl and her relatives shall be allowed, subject to such restrictions as may be necessary for the maintenance of discipline and order and for the welfare of the woman or girl.
A woman or a girl shall be allowed to write to and receive from approved correspondents not more than two letters a month. A woman or girl shall be allowed to receive a visit from three members of her close relatives for twenty minutes at any one time and at intervals of two times a month.
The Warden may at any time communicate to a woman or girl, or to her friends, any matter of importance to such woman or girl.
The degree of supervision to be exercised during visits shall be at the discretion of the Warden.
Home leave.
( 1)
The Warden may permit a woman or a girl to leave the place of safety on such conditions and for such period as the Warden may specify. If a woman or girl breaks such conditions she shall be liable to be dealt with as though she has been on conditional discharge.
Such permission shall be given in such form as the Commissioner may determine.

Visit by legal adviser.

The legal adviser of any woman or girl shall be allowed to see her in reference to any legal matters and shall be supervised by an officer of the place of safety.
For the purpose of this rule, "legal adviser" means the counsel or solicitor for a woman or girl, or the authorised clerk of such counsel or solicitor.
Visit by police officer.
On production of an order from the Commissioner of Police or someone on his behalf, a police officer may visit a woman or girl in the presence of an officer of the place of safety.
Letters.
A letter to or from a woman or girl may be read by the Warden or by a responsible officer deputed by her for such purpose, and it shall be within the discretion of the Warden to stop any letter, if she considers the contents are contrary to these Rules.
Reports on woman or girl.
A report on a woman or girl shall be dealt with by the Warden.
Woman or girl may be segregated.
When a woman or girl has been reported for an offence, the Warden may order her to be kept apart from ot~er women or girls pending investigation.
Woman or girl to be informed of alleged offence.
A woman or girl shall, before a report on her is dealt with, be informed of the offence for which she has been reported and shall be given an opportunity to hear the facts alleged against her and to defend herself.

Offences.
A woman or girl shall be guilty of an offence against discipline if she-
(a} disobeys an order of the Warden or any other officer;
(bJ is idle, careless, negligent at work, or refuses to work;
commits personal violence against any officer, employee of the place of safety or other women or girls;
in any way offends these rules or the good order and discipline of the place of safety;
The Warden shall investigate any woman or girl alleged to have committed any offence against discipline under rule 4 7 and if the Warden is satisfied that she has committed such offence, the Warden may impose on her one or more of the following punishments with the approval of the Commissioner -
deprivation of any of the following privileges for a period not exceeding one month -
An offence against discipline shall be reported forthwith to the
Superintendent.

Discharge Committee's and Superintendent's powers.
( 1)
Where a woman or girl is reported for any of the following offences -
(a} escaping from the place of safety or from legal custody;
a serious or repeated offence against discipline for which the imposed punishment is deemed by the Warden as insufficient;
an offence which the Warden, having regard to the circumstances of the case, thinks it expedient that the Discharge Committee should adjudicate, the Warden may forthwith report the offence to the Chairman of the Discharge
Committee, who shall thereupon arrange for at least two members of the
Committee to enquire into the report.
Where an enquiry is made pursuant to sub-rule (1) the Discharge
Committee may impose one or more of the following punishments
(il any punishment under rule 48(1);
If the Discharge Committee has insufficient quorum, the offences under sub-rule (1) shall be reported to the Superintendent, and the Superintendent shall have authority to enquire into the report and deal with it in the same manner as the Discharge Committee.
Pardon or reduction.
A disciplinary punishment pursuant to rule 48(1) may be pardoned or reduced by the Commissioner or Superintendent.
Request to see Superintendent, Warden or member of the Discharge Committee.
A request by a woman or girl to see the Superintendent, Warden or a member of the Discharge Committee shall be recorded by the officer to whom it is made and shall be conveyed, without delay, to the Warden, who shall inform the 1100
Superintendent or member of the Discharge Committee, as the case may be, of such request.
The Warden shall, at a convenient hour every day, other than Fridays,
Sundays and public holidays, see the woman or girl who has requested to see her.
Classification of women and girls.
The Superintendent shall classify all women and girls having regard to their character with their previous history and other relevant circumstances and shall arrange for each woman or girl to receive suitable teaching instruction at the place of safety.
Women and girls to be divided into grades.
A woman or girl may be placed in a grade called the Penal Grade by order of the Warden, if she is satisfied that such woman or girl is a bad influence, idle or ill-conducted. No woman or girl shall be placed in the Penal Grade longer than is necessary in the interests of herself or others. While in the Penal Grade such woman or girl shall not work with other women or girls.
A woman or a girl shall not be promoted in grade, except after full consideration of the circumstances of her case by a Board, called the "Place of
Safety Board", composed of such officers as the Superintendent may decide. The
Board may also order reversion to a lower grade, if, for some reason other than an act of misconduct, they consider it desirable.
Conditio.1al Discharge after six months.
A woman or girl shall become eligible for conditional discharge after such woman or girl has been detained for six months. If the Place of Safety Board, after consideration of her character and conduct, are of the opinion that there is a reasonable probability that she will lead a useful and industrious life, they shall so recommend to the Commissioner.
The Commissioner shall consider any recommendation made to her under this rule and she may, if she thinks fit, recommend to the Discharge 1101
Committee that the woman or girl be discharged subject to such conditions as she shall impose.
If the Commissioner is satisfied that a woman or a girl who has been discharged has escaped from the supervision of the person under whose care she has been placed, or is guilty of serious and wilful breach of the conditions of her conditional discharge and the case cannot be dealt with by advice and warning, she may revoke the conditional discharge.
A woman or a girl whose conditional discharge has been revoked may, on readmission to the place of safety, be placed in the Penal Grade for such length of time as the Warden shall deem necessary, having regard to all the circumstances of the case.
Forms for conditional discharge and revocation of conditional discharge shall be in such form as the Superintendent may determine.
Officer to conform to rules.
( 1)
An officer shall conform to the rules of the place of safety and shall support the Warden in the maintenance thereof.
An officer shall report to the Warden any abuse or impropriety which may come to her knowledge.
No absence without leave.
No officer shall be absent from a place of safety without leave of the
Superintendent.
Health of woman or girl to be brought to notice of Warden.
An officer shall direct the attention of the Warden to any woman or girl, whether she complains or not, who appears to be unwell or whose state of mind appears to require special notice and care. The Warden shall without delay bring such cases to the notice of the Superintendent and Medical Officer.

Officers dealing with women and girls.
An officer, when dealing with a woman or girl, shall only use such reasonable force as is necessary.
No officer shall deliberately act in a manner calculated to provoke a woman or a girl.
No officer shall discuss her duties or any matters of discipline or arrangements of a place of safety within the hearing of a woman or girl.
No officer shall deal with a woman or girl for an improper purpose.
Officers not to act on behalf of woman or girl.
No officer shall, without the authority of the Superintendent, carry out any pecuniary or business transaction with, or on behalf of, a woman or a girl.
No officer shall, without the authority of the Warden, bring in or carry out, or attempt to bring in or carry out, or knowingly allow to be brought in or carried out, to or from a woman or a girl any article whatsoever.
Officers not to receive fees.
No officer shall receive any fee, gratuity or other consideration in connection with the admission of any visitor.
Communication with previous occupants.
No officer shall communicate with a previous occupant of a place of safety or with the friends or relatives of a previous occupant, except with the knowledge of the Warden.
Officers and staff to submit to search.
Any officer or staff of a place of safety shall submit herself to be searched if called upon to do so by the Warden.
Officers not to communicate with press.
No officer shall make any unauthorised communication to any representative of the press on matters which have come to her knowledge in the course of her official duties.

No officer shall, without the authority of the Commissioner, publish any matter, or make any public pronouncement relating to a place of safety or a woman or a girl.
Clothing allowance.
An of:&cer who is required to wear civilian clothes as part of her duties shall be paid a clothing allowance at a rate of thirty dollars per month.
Teaching allowance.
An allowance for part-time teaching shall be paid in accordance with the rates paid by the Ministry of Culture, Youth and Sports, Ministry of Education or
Ministry of Religious Affairs, as the case may be.
Responsibilities of Warden.
The Warden shall be responsible for the maintenance of discipline in the place of safety.
The Warden shall also be responsible for all properties in a place of safety and shall keep the following records -
{a) an inventory of the furniture and tools;
{b)
a diary in which all occurrences of importance within the place of safety must be recorded;
{c) a nominal record of each woman or girl showing the date and period of her stay, the names and addresses of her parents, if known, any distinguishing marks, general appearance, race, language, nationality, apparent age, health, height and weight;
{d) a record of the conduct and health of a woman or girl while in the place of safety;
{e) a punishment book in which all punishments shall be recorded;
{f)
observations by members of the Discharge Committee;
{g)
an account book of all materials purchased for use in the workshops and the disposal thereof;

{hj a record of all articles made in the place of safety, and of all sales of such articles, showing cost of materials connected thereof.
In the absence of the Warden, the Assistant Warden shall have the powers and duties of the Warden.
The Warden and Assistant Warden shall not be absent from a place of safety at the same time.
The Assistant Warden and the subordinate staff of the place of safety shall be under the orders of the Warden.

General duties.
The Warden shall exercise a close and constant personal supervision of the place of safety. She shall visit and inspect daily all parts of the place of safety or a woman or girl who has been hospitalised.
The Warden shall, from time to time, visit the place of safety during the night. Such visits shall be made at varying intervals and at varying times and not less than twice a fortnight.
The Warden shall interview a woman or girl as soon as possible on arrival and prior to her discharge.
Power to suspend.
The Warden, in cases of misconduct, may suspend any officer and shall report the particulars without delay to the Commissioner, if available, or otherwise to the Superintendent.
Warden to carry out recommendations of Medical Officer.
The Warden shall, so far as practicable, carry into effect any written recommendation made by the Medical Officer for the alteration of the discipline or treatment of any woman or girl.
Warden to inform relatives of seriously ill woman or girl.
When a woman or girl is, in the opinion of the Medical Officer, seriously ill, the Warden shall whenever practicable inform the nearest relative of such woman or girl.

Warden to report cases of insanity.
The Warden shall, without delay, report to the Superintendent any case of insanity or apparent insanity occurring among the women and girls or any case in which the Medical Officer has submitted a report under rule 83 or 84(2), (3) or (4).
Warden to maintain place of safety in proper order.
The Warden shall pay attention to the ventilation, drainage and sanitary condition of the place of safety, and take such measures as may be necessary to maintain them in proper order.
Warden to notify Coroner etc. of death of woman or girl.
Upon the death of a woman or girl, the Warden shall give immediate notice thereof to the Coroner, the Commissioner, the Superintendent and, where practicable, to the nearest relative of the deceased.
Inquest on a woman or girl.

The Warden shall supply the Coroner the name of any woman or girl who can give relevant evidence in an inquest on the death of a woman or girl.
After any inquest the Warden shall report to the Superintendent the findings of the inquest and such other circumstances of importance as may arise at the inquest.
Appointment of officer in the absence of Warden.
The Superintendent may appoint any offi.cer to perform, in the absence of the
Warden and Assistant Warden, all or any of the duties required to be performed by the Warden.
Visitors to place of safety.
The Superintendent and the Warden may, in the exercise of their discretion, allow any person to visit the place of safety.
No person visiting a place of safety shall, without the permission of the
Warden, take any photograph and this permission shall not be granted unless an undertaking is given that the photograph will not be published without the authority of the Superintendent.

Removal of visitor for misconduct.
The Warden may remove from a place of safety any visitor whose conduct is in her opinion improper.
Fire precautions.
The Warden shall ensure that proper precautions against fire are adopted and that appliances for extinguishing fire are at all times kept in good order and ready for use. She shall take care that instructions are ·given as to the steps to be taken in cases of fire and that all officers are acquainted with their duties in such an event.
General duties.
The Medical Officer shall be responsible for the general care of the health of the women and girls.
Report by Medical Officer.
The Medical Officer shall report to the Superintendent, through the Warden, any circumstances connected with the place of safety or the treatment of the women and girls, which, at any time, appears to him to require consideration on medical grounds.
Visits by Medical Officer.
Notwithstanding the other provisions of this rule, the Medical Officer shall, is practicable, visit the place of safety daily and at such times as the Director of Medical Services may determine.
The Medical Officer shall examine a woman or girl as soon as possible after her admission and before discharge. On each occasion the Medical Officer shall record the health of the woman or girl and such particulars as the
Superintendent may determine.
The Medical Officer shall see a woman or girl who complains of illness, and shall report to the Warden in writing regarding her fitness or otherwise to perform her work. She shall visit a sick woman or girl at such times as may be necessary. She shall attend as soon as is practicable on receiving information of the serious illness of any woman or gir 1.

The Medical Officer shall regularly visit a woman or girl under restraint, confined to a room, on restricted diet, and any other woman or girl to whom his attention is specially directed.
The Medical Officer shall regularly examine the provisions made for cleanliness and sanitation and examine that they are in efficient working order.
She shall report to the Warden any defect or insufficiency therein.
The Medical Officer shall keep a record of the death of a woman or girl, which shall include the following particulars-
{a}
the time and date when the deceased was taken ill and when the illness was first notified to her;
{b}
the nature of the disease;
{c}
an account of the results of any post-mortem examinations made and any special remarks that appear to her to be required.
Quarterly inspection.
Once every three months, the Medical Officer shall inspect every part of a place of safety, for the purpose of ascertaining that nothing exists therein that is likely to be injurious to the health of the women and girls, and that the ventilation is sufficiently provided for and properly maintained. The result of this inspection shall be reported to the Superintendent.
Food inspection.
The Medical Officer shall frequently inspect cooked and uncooked food at a place of safety. She shall report to the Warden as to the state and quality of the food, any deficiency in the quantity or quality of the water, the sufficiency of clothing and bedding, and on other matters which may affect the health of the women and girls.
Reports on dangers to woman's or girl's health.
( 1)
Whenever the Medical Officer has reason to believe that the health of a woman or girl is likely to be injuriously affected by the discipline or treatment in a place of safety, she shall report the case in writing, through the Warden, to the
Superintendent, together with such recommendations as she thinks proper.
Whenever the Medical Officer is of the opinion that the life of any woman or girl will be endangered by continued discipline, or that any sick woman or girl will not survive her detention, or is totally and permanently unfit for training, she shall report her opinion and the grounds thereof in writing, through the Warden to the Superintendent.

Whenever any woman or girl appears to the Medical Officer to be seriously ill, she shall give notice thereof to the Warden.
(4}
The Medical Officer shall report, in writing to the Warden, the case of any woman or girl to which she thinks is necessary, on medical grounds, to draw attention, and shall make such recommendations as she thinks necessary for the alteration of the discipline or treatment of the woman or girl, or for the supply to her of additional articles.
Mental health of a woman or girl.
(1}
The Medical Officer shall keep close observation on any woman or girl whose mental condition appears to require it. If necessary, she shall take steps as she may consider proper with a view to the segregation or removal of such woman or girl to a safe place designated for the observation of weak-minded women or girls, or to the certification of the woman or girl under any law relating to lunacy, mental deficiency or disorder.
(2}
The Medical Officer shall report to the Superintendent, through the
Warden, any cases of a woman or girl whose mental health appears likely to become impaired by continued discipline or treatment.
Contagious diseases.
The Medical Officer shall submit to the Warden, in writing, a recommendation for separating from other women and girls, any woman or girl suffering, or suspected of suffering, from any infectious or contagious disease, and shall immediately take steps to treat such disease.
Appointment of suitable officers.
Where a place of safety is divided into houses, the Superintendent shall appoint suitable officers to be responsible for the administration of each house, subject to the general directions of the Warden.
Assistant Warden.
One or more Assistant Warden may be attached to each house and shall be subject to the directions of the Warden.

Duties of an Assistant Warden.
An Assistant Warden shall devote herself to the mental, physical and moral improvement and development of each woman or girl under her charge.
Assistant Warden officer of place of safety.
An Assistant Warden shall be an officer of a place of safety and the rules for officers generally shall apply to her.
Appointment, duties and power of the Discharge Committee.
( 1)
The Minister shall appoint a committee to be called "The Discharge
Committee".
Any member of the Discharge Committee may at any time visit any place of safety and during such a visit may-
hear complains, if any, of the women and girls and question any woman or girl or member of staff.
During a visit to a place of safety, a member of the Committee shall-
call the attention 'of the Warden to any inequality that may be observed in the working of the place of safety or in the treatment of any woman or girl;
exercise and perform such other powers and duties as the
Commissioner may determine.
(4}
The Committee shall appoint one or more of its members, in rotation, to visit a place of safety in every month.
