Section 69

The strata corporation, a creditor of the body corporate or any person having a registered interest in a unit may apply to the Court for the appointment of an administrator.

The Court may, in its discretion on cause shown, appoint an administrator for an indefinite period or for a fixed period on such terms and conditions as to remuneration or otherwise as it thinks fit. The remuneration and expenses of the administrator shall be an administrative expense for the purpose of paragraph (a) of subsection (1) of section 31.

Subject to subsection (7), the administrator shall, to the exclusion of the strata corporation and the committee, have and exercise the powers of the strata corporation and the committee and be subject to the duties of the strata corporation and the committee or such of those powers and duties as the Court orders.

The administrator may, in writing, delegate any of the powers so vested in him and at any time revoke such delegation.

The Court may, in its discretion on the application of the administrator or any other person referred to in subsection (1), remove or replace the administrator.

On any application made under this section the Court may make such order for the payment of costs as it thinks fit.

Nothing in this section shall permit an administrator to do anything which requires a unanimous resolution or prevent the passing of a unanimous resolution; but without restricting the generality of subsection

, the administrator shall, subject to any order of the Court, be entitled on his own initiative and to the exclusion of the strata corporation, to do any act which under the Rules may be done by special resolution only.

An administrator when appointed shall forthwith lodge with the

Commissioner a sealed copy of the Court making the appointment.
