Section 39
(1)
An application for approval for the purposes of section 38 shall be made to the Registrar General and upon receipt of such an application, the
Registrar General shall —
(a)
examine the application;
(b)
in relation to its instrument of government, consider the constitution of the higher educational institution; and
(c)
make appropriate recommendations to the Minister with respect to —
(i)
its approval or otherwise; and
(ii)
any conditions that may be considered necessary.
(2)
Subject to subsection (1), the Minister may —
(a)
approve the application with or without any conditions;
(b)
approve the constitution contained in the instrument of government; or
(c)
refuse the application and specify the grounds of the refusal.
(3)
Where the
Minister approves the application under subsection (2)(a), he may require the applicant to pay the prescribed fee.

(4)
Upon refusal of the application under subsection (2)(c), the
Registrar General shall inform the applicant in writing of the Minister’s decision.
(5)
The decision of the Minister to refuse an application is final.
