Section 287
(1)
In dealing with any appeal under this Chapter, the High Court may, if it thinks additional evidence to be necessary or any witness should be recalled, either take such evidence itself or direct it to be taken by a
Magistrate.
(2)
When the additional evidence is taken by a Magistrate, he shall certify such evidence to the High Court which shall thereupon, as soon as may be, proceed to dispose of the appeal.
(3)
Unless the High Court otherwise directs, the accused shall be present when the additional evidence is taken.
