(a)
proceedings under this Order are civil proceedings;
(b)
any question of fact to be decided by a court on the application under this Order is to be decided on the balance of probabilities;
(c)
the rules of construction applicable only in relation to criminal law do not apply in the interpretation of this Order;
(d)
the rules of evidence applicable in civil proceedings apply to proceedings under this Order.
