Section 139

For the purposes of this Code, “qatlu syibhil-’amd” means an act which is done voluntarily and with intent to cause harm to the body or mind of a person, which causes death of that person or any other person, whether or not the act is done by means of a weapon and the act which in the ordinary course of nature is not likely to cause death.

Illustration

A in order to cause hurt, strikes B with a walking stick or stone which in the ordinary course of nature is not likely to cause death. B dies as a result of such hurt. A commits qatlu syibhil-’amd.
