(1)

Any person who has sexual intercourse with any person whom he or she is, and who he or she knows or has reason to believe that he or she is, forbidden by Muslim law to marry, is guilty of an offence: Penalty, in the case of —
(a)
a male person, imprisonment for 5 years; and
(b)
a female person, imprisonment for one year.
(4)
Save in the cases referred to in subsection (3), whoever is guilty of illicit intercourse, whether or not the other party to such illicit intercourse professes the Islamic religion, is guilty of an offence and liable on conviction to a fine of $5,000 or imprisonment for 6 months.
