Section 38
Penalty for offences not otherwise provided for
Any person who contravenes any provision of this Act for which no penalty is expressly provided is guilty of an offence and liable on conviction -
(a)
in a case where the contravention is of such a nature as to endanger or is likely to endanger human life -
(i)
in the case of an individual, to a fine not exceeding $50,000, imprisonment for a term not exceeding 12 months or both;
(ii)
in the case of a body corporate, to a fine not exceeding $1 (3,000,000; or
(b)
in any other case -
(i)
in the case of an individual, to a fine not exceeding $10,000, imprisonment for a term not exceeding 3 months or both;
(ii)
in the case of a body corporate, to a fine not exceeding $1 0,000,000.
