Section 38
No probate of letters of administration shall be granted to a lunatic or a person of unsound mind, but where any such person, if of sound mind, would be entitled to probate or letters of administration, letters of administra-tion with or without the will annexed, as the case may be, may be granted to the person to whom the care of his estate has been lawfully committed, or to such other person as to the Probate Officer seems fit, for the use and benefit of the lunatic or person of unsound mind, until he becomes of sound mind and obtains a grant to himself.
