Section 41
(1)
Any person who, being a person held in custody pursuant to a direction under subsection (2) of section 40, escapes from custody is guilty of an offence and liable on conviction to a fine not exceeding $10,000, imprisonment for a term not exceeding 2 years or both.
(2)
Any police officer may, without warrant, arrest any person if he has reasonable grounds to believe that he is a person referred to in subsection (1).
(3)
A person who has been so arrested shall be returned to custody in accordance with the direction.
