This Act may be cited as the Legislative Council and Council of

Ministers (Remuneration and Privileges) Act.

His Majesty the Sultan and Yang Di-Pertuan may by order make provision for the remuneration of Members of the Legislative Council and of the Council of Ministers.

The remuneration payable under the provisions of section 3 shall —

The moneys required for the remunerations payable under this Act shall be a charge on the Consolidated Fund.

His Majesty the Sultan and Yang Di-Pertuan may by order published in the Gazette add to or amend the Schedule to this Act.

(section 3)

ALLOWANCES AND PRIVILEGES OF MEMBERS

1.

Correspondence —

Members of the Legislative Council are authorised to transmit free of charge all correspondence on Government business. The correspondence should be enclosed in envelopes marked “ON GOVERNMENT SERVICE” and the bottom left hand corner of the envelopes shall be signed by the Member sending the letter over a “chop”

“MEMBER OF THE LEGISLATIVE COUNCIL”. The privilege will cover correspondence within Brunei Darussalam only and it will not include the right to frank registered articles or airmail correspondence.

When an article, airmail, correspondence or any telegram is required to be sent or a trunk call has to be made by a Member on Government business, the cost incurred thereby may be recovered.

2.

Government publications —

A Member shall be supplied, free of charge, with copies of Government Gazettes,

Enactments, Reports and other Government publications.

3.

Motor vehicle licence —

A Member shall be entitled to an exemption from any annual licence fee payable under the Road Traffic Regulations (Rg 1 of Chapter 68) in respect of one car registered in the

Member’s name during the tenure of office.

4.

Loans to purchase motor vehicle etc. —

A Member may, at the discretion of the Minister, be granted a loan of not exceeding the amount which may be advanced to an officer of the public service in Division II of B2

salary scale and below to cover the cost of a motor car, motorcycle or outboard motor upon the Member giving adequate security and written undertaking, subject to such terms and conditions as may be required by the Minister, that the said loan will be repaid in full before the normal expiry of the Member’s tenure of office.

5.

Mileage allowance —

A Member may draw mileage allowance at the same rates and subject to the same conditions as an officer of the public service in Division II of B2 salary scale and below for journeys connected with a specified duty:

Provided that a Member who does not use or own his own car or boat may claim reimbursement of the actual travelling expenses incurred by him in connection with that journey.

6.

Allowance for travelling outside Brunei Darussalam —

A Member required by the Government to travel outside Brunei Darussalam on

Government business may be paid a subsistence allowance notified in the Gazette to cover board and out-of-pocket expenses but not including fares and lodging expenses which will be paid by the Government.

7.

Travelling outside Brunei Darussalam —

A Member required to travel outside Brunei Darussalam on Government business by sea or air may with the approval of the Minister or an officer authorised by him in that regard, be granted a travel warrant and the cost of such travel shall be paid by the

Government.

8.

Motor vehicle badges —

A Member using his own motor vehicle or a motor vehicle placed at his disposal for his use may carry on such vehicle a distinctive badge or badges in such form as may be authorised by His Majesty the Sultan and Yang Di-Pertuan.

9.

Medical facilities —

A Member, his wife, children and parents (including parent-in-law) shall be entitled to free medical and dental treatments including specialist treatment and to admission to first-class ward, or, in default of any such eligibility, to reimbursement of any sum expended by him or such treatment.

10.

Telephone —

(1)

Members are each entitled to have a telephone installed free of charge at their usual place of residence. The Director of Telecommunications will make arrangements to install the telephone provided such installation is practicable.

A Member who uses a telephone at his normal place of residence may recover from the Government the charges for telephone rentals (but excluding trunk call charges) for the telephone during his tenure of office as a Member:

Provided that a Member who is enjoying the use of a telephone free of charge by virtue of any other Government appointment may not be granted this privilege.

11.

Subsistence allowance —

The Speaker, Ministers and Deputy Ministers will be entitled to subsistence allowances at the same rates and subject to the same conditions as an officer in Division I of the public service.

A Member, other than the Speaker, a Minister or a Deputy Minister, may be paid a subsistence allowance at the rate notified in the Gazette.

12.

Resthouse and Holiday Bungalows —

A Member shall be entitled to the same privileges in respect of Government Resthouse and Holiday Bungalows as accorded to an officer in Division I of the public service.

13.

Priorities —

A Member shall be entitled to the same priorities in respect of all public utilities and services as are accorded to an officer in Division I of the public service.

14.

Honorific —

A Member shall be entitled to the appellation of “The Honourable” preceding his name.
