Section 26
(1)
The transfer of any contract from one employer to another shall be subject to the consent of the worker and the endorsement of the transfer upon the contract by the Commissioner.
(2)
Before endorsing the transfer upon the contract the

(a)
shall ascertain that the worker has freely consented to the transfer and that his consent has not been obtained by coercion or undue influence or as the result of misrepresentation or mistake; and
(b)
in any case in which by such transfer the worker —
(i)
will change his form of employment from one the subject of an exemption made under the provisions of subsection (4) of section 23; or
(ii)
will be subject to such change in conditions as in the opinion of the Commissioner renders such a course advisable, may require the worker to be medically examined or re-examined as the case may be.
