Section 61
(1)
Subject to Hukum Syara’, the Court may order a husband to pay maintenance to his wife or former wife.
(2)
Subject to Hukum Syara’ and confirmation by the Court, a wife shall not be entitled to maintenance when she is nusyuz or unreasonably refuses to obey the lawful wishes or commands of her husband, including —
(a)
when she withholds her association with her husband;
(b)
when she leaves her husband’s home against his wishes; or
(c)
when she refuses to move with him to another home or place, without any valid reason in accordance with Hukum Syara’.
(3)
When a wife who is nusyuz, repents and obeys the lawful wishes and commands of her husband, she ceases to be nusyuz.
