Section 108

Where the father and grandfather of a minor have died without appointing a testamentary guardian, any penghulu, village heads, mosque official, any relevant public servant or any person taking care of the minor, may cause the minor to be taken before the Court and the Court may appoint a guardian either for the minor, the property of the minor or both.
