(1)
Subject to subsections (2) and (3), this Part applies only to an IBC which has share capital (whether it is limited by shares or limited by guarantee).
(2)
Sections 47 and 48 apply only to an IBC limited by guarantee, whether or not it has share capital.
(3)
Section 49 applies to all IBCs.
