Section 3 — Industrial Designs Order, 1999

This Order does not apply to computer programs and layout designs.

(2)

Provision may be made by rules under section 77 for excluding from registration under this Order industrial designs for such articles of a primarily literary or artistic character as may be specified therein.

In subsection (1) –

“computer program” means an expression, in any language, code or notation, of a set of instructions (whether with or without related information) intended, either directly or after either or both of the following –

(a)

the conversion to another language, code or notation;

(b)

the reproduction in a different material form, to cause a device having information-processing capabilities to perform a particular function;

“layout design” means the three-dimensional disposition, however expressed, of the elements, at least one of which is an active element, and of some or all of the interconnections, of an integrated circuit (as defined in section 2 of the

Emergency (Layout Designs) Order, 1999); and includes such a three-dimensional disposition prepared for an integrated circuit intended for manufacture.
