Section 53
Forfeiture and disposal of vessels etc.
(1)
Where any person is guilty of an offence against this Act, the court may, in addition to any other penalty that may be imposed —
(a)
order that the vessel (including its equipment, furniture, stores, cargo and fishing appliances), vehicle, aircraft, article or thing used in the commission of such offence or in relation to which such offence has been committed be forfeited; and
(b)
order that any fish caught in the commission of such offence or the proceeds of the sale of any fish or other article of a perishable nature referred to in section 54, and any explosive, poison, pollutant or other noxious substance, apparatus, prohibited gear or any other thing used or intended to be used in the commission of such offence be forfeited.
(2)
Any vessel (including its equipment, furniture, stores, cargo and fishing appliances), vehicle, aircraft, article or thing, explosives, poison, pollutant or other noxious substance, apparatus, prohibited gear or any other thing, or fish, ordered to be forfeited under subsection (1) or under section 50
shall be disposed of in such manner as the Director may think fit.
