Section 38

Notwithstanding section 40, the Minister may provide in any regulations made under this Act which relate to the prohibition, regulation or control of the species of fish known as piranha or any other prescribed dangerous species of fish that a person who contravenes any provision thereof is guilty of an offence and liable on conviction to a fine not exceeding $50,000, imprisonment for a term not exceeding one year or both.

No prosecution in respect of an offence referred to in subsection (1) shall be instituted except with the consent of the

Public Prosecutor.
