Section 125
Power of Commissioner to confirm or set aside decisions by employers
(1)
The Commissioner may inquire into and confirm or set aside any decision made by an employer under section 26(1) and may make such consequential orders as may be necessary to give effect to his decision.
(2)
If the Commissioner sets aside any such decision, the consequential order against such employer shall be confined to payment of compensation in lieu of notice and other payments that the employee is entitled to as if no misconduct had been committed by the employee.
(3)
The Commissioner shall not exercise his power under subsection (1) unless the employee has made a complaint to him under the provisions of this Part within 30 days from the date on which the decision made by his employer under section 26 was communicated to him either orally or in writing by the employer.
