Section 110
(1)
Where –
(a)
a notice that has been given under section 109(1) or (3) is in force; and
(b)
an officer of customs forms the opinion that any goods that have been imported and are under customs control may be infringing copies, he may conduct such investigation as he considers necessary to establish whether or not the goods appear to be infringing copies.
(2)
Where an officer of customs conducts an investigation, he may, subject to section 111, require –
(a)
the claimant; and
(b)
any other person appearing to him to have an interest in the goods, to supply such information as he may specify within ten days of being required to do so.
(3)
Whether or not the officer of customs conducts an investigation, he shall make a determination whether or not the goods appear to be infringing copies.
(4)
Nothing in this section applies to any goods that have been imported for private and domestic use.
