Section 40

Any person who contravenes or fails to comply with subsection (1) of section 11 is guilty of an offence and liable on conviction to imprisonment for a term not exceeding 3 years, a fine not exceeding $200,000 or both, and, in the case of a continuing offence, to a further fine not exceeding $10,000

for every day or part of a day during which the offence continues after conviction.
