Section 13
Workmen's Compensation
(1)
Every employer shall give notice in writing to the
Commissioner of the occurrence of any accident on his pre-mises or cases of occupational disease as specified in section 5 in connection with anything done for the purpose of the employer's trade or business which -
(a)
results in the death of any person injured; or
(b)
totally or partially disables any person in-jured for more than three consecutive days from earning full wages at the work at which he was employed.
(2)
Such notice shall be given within 10 days of the occurrence of the accident in such form as may be pre-scribed.
(3)
A notice under this section may contain a denial of liability tp pay compensation and shall not be construed as an admission unless liability be admitted by clear and express words.
( 4) Any employer failing or omitting to give notice as required by this section shall be guilty of an offence:
Penalty, a fine of $4,000:
Provided that no Court shall take cognizance of an off-ence under this section except on the complaint of the Com-missioner.
(5)
For the purposes of this section "employer" shall include the person, if any, referred to in section 19 as "the principal".
