Power to seize vehicles and containers

Section 37
(1)
Any authorised officer may stop and seize any vehicle on the ground or in water, or stop in transit and seize any parcel, package, case, bag, luggage or other container, if he reasonably believes —
(a)
that the vehicle or container contains any species listed in the
Appendix; or
(b)
that the vehicle or container —
(i)
is in the possession of a person who has committed an offence against this Act; and
(ii)
has been used in connection with the commission of an offence against this Act.
(2)
In this section, “in transit” has the same meaning as in section 2(1)
of the Customs Order, 2006 (S 39/2006).
