Section 129
(1)
After hearing the evidence at any stage of any proceedings before the delivery of judgment, the prosecutor may, if he thinks fit, inform the Syariah Court that he does not propose further to prosecute the accused on the charge, and thereupon all proceedings on such charge against the accused may be stayed by leave of the Syariah Court and if so stayed, the accused shall be discharged of and from the same.
(2)
Such discharge shall not amount to an acquittal unless the
Syariah Court orders so after examining the evidence, except in cases under section 1 19.
