Section 168
(1)
Subject to th€ constitution and the prospectus, an operator of a public collective investment scheme or the custodian on the instructions of the operator, may borrow money for the use of the public collective investment scheme on terms that the borrowing is to be repayable out of the public collective investment scheme property.
