If any oil or oily mixture is discharged into Brunei Darussalam waters from any apparatus used for transferring oil from or to a ship, whether to or from a terminal or to or from another ship, the terminal operator or the person in charge of the apparatus shall be guilty of an offence and liable on conviction to a fine of not less than $1,000 and not more than $1,000,000, imprisonment for a term not exceeding 2 years or both.
