Section 40

For the avoidance of doubt, it is hereby declared that where a person has before the commencement of this Act committed an act which would have been an offence under this Act had it been in force at the time such act was committed, he shall, notwithstanding the provisions of any written or other law to the contrary, be guilty of an offence and liable to be prosecuted for that offence and the court shall have jurisdiction to try such offence under this Act.
