General penalty
of Maritime and Port Authority of Brunei Darussalam Act
Any person guilty of an offence under this Act or any regulations made thereunder for which no penalty is expressly provided is, in addition to the forfeiture of any article seized, liable on conviction to a fine not exceeding $5,000, imprisonment for a term not exceeding 6 months or both.
Offence by body corporate 101.
Where an offence against this Act has been committed by a body corporate, a partnership or unincorporated association of persons, any person who at the time of the commission of the offence was a director, manager,

Authority of Brunei Darussalanz partner, secretary or other similar officer thereof, or was purporting to act in any such capacity shall be guilty of that offence unless he proves that -
(a)
the offence was committed without his consent or connivance; and
(b)
he had exercised all such diligence to prevent the commission of the offence as he ought to have exercised having regard to the nature of his finctions in that capacity and to all the circumstances.
Jurisdiction of Courts 102.
A Court of a Magistrate shall have jurisdiction to hear and determine all offences against this Act or any regulations made thereunder and, notwithstanding anything to the contrary in the Criminal Procedure Code
(Chapter 7), shall have power to impose the full penalty or punishment in respect of any offence against this Act or any regulations made thereunder.
Composition of offences 103.
( 1 ) Any police officer not below the rank of Sergeant specially authorised by name in that behalf by the Minister, or any employee of the
Authority specially authorised by name in that behalf by the Chief Executive, may in his discretion, compound any such offence against this Act or any regulations made thereunder as may be prescribed as being an offence which may be compounded by collecting from the person reasonably suspected of having committed the offence a sum not exceeding $500.
(2)
The Minister may, with the approval of His Majesty the Sultan and Yang Di-Pertuan, make regulations prescribing the offences which may be compounded.
