Section 34
(1)
Any person who, being an undischarged bankrupt whether he was adjudged bankrupt by a court in Brunei Darussalam or elsewhere, acts as manager of any limited liability partnership without the leave of the High Court or the written permission of the Official
Receiver, is guilty of an offence and liable on conviction to a fine not exceeding $10,000, imprisonment for a term not exceeding 2 years or both.
(2)
On an application by an undischarged bankrupt under subsection (1) to the High
Court or the Official Receiver, the High Court or the Official Receiver, as the case may be, may refuse the application or approve the application subject to such conditions as the High
Court or the Official Receiver may impose.
(3)
The leave of the High Court for the purposes of this section shall not be given unless notice of intention to apply for leave had been served on the Official Receiver, and the
Official Receiver is heard on the application.
