(1)
Notwithstanding any contrary provisions in any written law, this
Act shall apply in any matter in which at least one of the parties professes the Islamic religion and at least one of the parties, whether or not he professes the Islamic religion, is in a bermukim manner in Brunei
Darussalam or is bermastautin in Brunei Darussalam but in a bermukim manner outside Brunei Darussalam.

For the avoidance of doubt, it is hereby declared that no Court other than a Court established under Part II of the Syariah Courts Act
(Chapter 184) shall hear or determine any claims or proceedings where at least one of the parties is a Muslim and related with any matters arising in this Act.
Criterion for deciding whether person is Muslim.
