Section 49
(1)
Whenever the husband to a marriage has taken an oath by way of li’an in accordance with Hukum Syara’ before a Syar’ie Judge and it has been so decided, the Syar’ie Judge shall sentence them to faraq and to be separated forever.
(2)
The Syar’ie Judge shall record a divorce by way of li’an accordingly and deliver a certified copy of the record to both the relevant
Registrar and the Chief Registrar for registration.
