Section 41
Save as is otherwise expressly provided, nothing in this Act shall authorise the Court to make an order of divorce or to permit a husband to pronounce a talaq except —
(a)
where the marriage has been registered or deemed to be registered under this Act;
(b)
where the marriage was contracted in accordance with
Hukum Syara’; and
(c)
where either parties to the marriage at the time when the application is presented is bermastautin in Brunei Darussalam.
Divorce by talaq or by order.
