Section 41

Any person who contravenes the provisions of section 40 shall be guilty of an offence and liable on conviction to a fine not exceeding $100,000 and to imprisonment for a term not exceeding 2 years, and any such contravention shall constitute a breach of statutory duty actionable at the suit of any person who suffers loss or damage by virtue of that contravention.
