Section 80
(1)
Subject to this section, any person who makes a representation that an industrial design applied to any article disposed of by him for value is registered in respect of that article is guilty of an offence and liable on conviction to a fine not exceeding ten thousand dollars.
(2)
For the purpose of subsection (1), a person who for value disposes of an article having stamped, engraved or impressed on it or otherwise applied to it the word “registered”
or anything expressing or implying that an industrial design applied to the article is registered in respect of that article, shall be taken to have made a representation that the industrial design applied to the article is registered in respect of the article.
(3)
In proceedings for an offence under this section it shall be a defence for the accused to prove that he used due diligence to prevent the commission of the offence.
