Section 58
(1)
An appeal to the court lies from any decision of the Registrar under this Order, except as otherwise expressly provided by rules or regulations made under this Order.
(2)
Any appeal under this Order which concerns an application for registration of an industrial design shall be heard in Chambers unless the court otherwise directs.
(3)
In any appeal under this Order –
(a)
the Registrar shall be entitled to appear and be heard; and
(b)
the Registrar shall appear if so directed by the court.
(4)
In addition to its powers under any other law, in any appeal the court has the same discretionary powers as have been conferred upon the Registrar by this Order.
(5)
In this section, “decision” includes any act of the Registrar made in the exercise of a discretion vested in him by or under this Order.
