Criminal Procedure Code that at the time when the act was committed, in respect of which the accused person is charged, he was by reason of unsoundness of mind incapable of knowing the nature of the act or that it was wrong or contrary to law, shall proceed with the case and, if the accused person ought, in the opinion of the
Magistrate to be committed for trial before the High Court, the Magistrate shall so commit him.
