Darussalam
(1)
When any person in the presence of a police officer or
District Officer commits or is accused of committing a non-seizable offence a and refuses on the demand of a police officer or District Officer to give his name and residence or gives a name or residence which such officer has reason to believe to be false, he may be arrested by such police officer or
District Officer in order that his name or residence may be ascertained, and he shall, within 24 hours of the arrest, exclusive of the time necessary for the journey, be taken before the nearest Magistrate unless before that time his true name and residence are ascertained, in which case such person shall be forthwith released on his executing a bond for his appearance before a Court if so required.

When any person is thus brought before a Magistrate, the
Magistrate may either require him to execute a bond, with or without a surety, for his appearance before a Court if so required, or may order him to be detained in custody until he can be tried.
(3)
When any person in the presence of a police officer or
District Officer commits or is accused of committing a non-seizable offence and on the demand of a police officer or District Officer to give his name and residence gives as his residence a place outside Brunei Darussalam, he may be arrested by such police officer or District Officer and shall be brought forthwith either before the nearest Magistrate who may require him to execute a bond, with or without a surety, for his appearance before a Court if so required, or may order him to be detained in custody until he can be tried, or before a police officer in charge of a police station who may require him to a furnish a bond, with or without a surety, for his appearance before a Court if required.

A District Officer making an arrest without a warrant shall without unnecessary delay make over the person so arrested to the nearest police officer or in the absence of a police officer, take such person to the a nearest police station, and a police officer shall receive every such person into custody.
