(1)
A person exercising the right conferred by section 142, or who has given notice to the Copyright Tribunal of his intention to do so, may refer to the Copyright Tribunal –
(a)
any question whether any condition as to the inclusion in a broadcast or cable programme service of sound recordings, notice of which has been given to him by the licensing body in question, is a reasonable condition; or
(b)
any question whether any information is information which the licensing body can reasonably require him to provide.
(2)
On a reference under this section, the Copyright Tribunal shall consider the matter and make such order as it may determine to be reasonable in the circumstances.
