Opening note
This Act may be cited as the Brunei Darussalam Fishery Limits Act.
Interpretation.
In this Act —
“fish” includes any of the varieties of marine brackish water or fresh water fishes, crustacea, aquatic mollusca, marine sponges, trepang and other acquatic life, but does not include turtles or their eggs;
“fishing boat” means any vessel for the time being employed in fishing operations or any operations ancillary thereto;
“miles” means international nautical miles of 1,852 metres.
Brunei Darussalam fishery limits.
Subject to the following provisions of this section, Brunei
Darussalam fishery limits extend to 200 miles from the baselines from which the breadth of the territorial sea adjacent to Brunei Darussalam is measured.
Pending the making of an order as provided in subsection (3), and without prejudice to any claim to wider limits of Brunei Darussalam in accordance with international law, as a transitional measure, where the median line, as hereinafter defined, is less than 200 miles from the baseline referred to in subsection (1), Brunei Darussalam fishery limits shall extend to the median line. The median line is a line, every point of which is equidistant from the nearest point of, on the one hand, the baselines referred to in subsection (1) and, on the other hand, the coresponding baselines of other countries.

His Majesty the Sultan and Yang Di-Pertuan in Council* may by order declare the Brunei Darussalam fishery limits extend to such other line as may be specified in the Act.
References to Brunei Darussalam fishery limits in the Fisheries
Act (Chapter 61) (repealed by the Fisheries Order, 2009 (S 25/09)) or in any other written law for the time being in force are to the limits set by or under this section.
