BRUNEI INTERNATIONAL AIRPORT

BYE-LAWS, 1999

Opening note

Preamble

In exercise of the power conferred by subsection {2) of section 3 of the Air Navigation Act, the Director of Civil Aviation with the approval of the Minister of Communications hereby makes the following bye-laws-PART I PRELIMINARY l. These bye-laws may be cited as the Brunei International Airport Bye· Citation. laws, 1999.

Section 2

In these by.e-laws, unless the context otherwise requires 709

"Airport" means the Brunei International Airport;

"airport official" means a person authorised in writing by the

Director of Civil Aviation to perform specified functions under these bye-laws;

"airside" means areas within the security fence and on the airport side of any security barrier;

"authorised officer" means any officer of the Department of Civil

Aviation or any person duly authorised by the Director to act on his behalf;

"Director" means the Director of Civil Aviation and includes an airport official;

''landside'' means areas which are not airside;

"manoeuvring area" means the part of an aerodrome provided for the landing and take-off of aircraft including the surrounding safety zones and the taxiways by excluding any part of aerodrome set aside for the embarkation and disembarkation of passengers, the loading and unloading of cargo, the maintenance or parking of aircraft;

"movement area" means that part of an aerodrome provided for the landing and take-off of aircraft, the embarkation and disembarkation of passengers, the loading and unloading of cargo, the maintenance or parking of aircraft;

Prohibition on vehicles used in airside.

"park" means to bring a vehicle to a stationary position and cause it to wait for any purpose other than that of immediately taking up or setting down passengers, goods or luggage;

"prohibited area" means that part of the aerodrome where no person is permitted to enter unless he is the holder of an airport security pass;

"traffic signs" include all signals, warning signs, posts, direction posts, sign, lines, lamps or other devices for the guidance or direction of persons using the aerodrome.

Section 3

These bye-laws are applicable -

{a}

within the Passenger Terminal Building, the Air Cargo

Building and other buildings forming part of the Airport;

(b)

within all car parks adjacent to the A_irport buildings;

{c)

within the areas surrounding the approach lighting at either end of the runway and the adjacent roads;

(d)

otherwise all areas within the Airport boundary, with the exception of confines of His Majesty the Sultan's Flight and Royal

Brunei Air Force Military Airbase.

Section 4

The Director may in his discretion exempt any person or any vehicle from these bye-laws.

Section 5

Any person who acts in contravention of or fails to comply with any of these bye-laws or fails to comply with any of the conditions of any airport vehicle permit or airport security passes issued under these bye-laws shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $2,000.00 or to imprisonment for a term not exceeding 6

months or both.

Part II

PROVISIONS RELATING TO VEHICLES AND PERSONS

WITHIN THE AIRSIDE

Section 6

Except as otherwise provided by these bye-laws, no person shall use or cause or permit to be used a vehicle within the airside unless there is in force of the vehicle an airport vehicle permit issued under these bye-laws.

An application for an airport vehicle permit in respect of any vehicle and airport security pass shall be made to the Director.

Section 8

The Commissioner of Police shall be the authority for the issuance of airport vehicle permits. The airport vehicle permits shall be issued on the recommendation of the Director and may be made subject to such conditions as the Commissioner of Police may require and shall state the areas of the Airport on which the vehicle is allowed to be and the period of validity of the permit.

Section 9

The Commissioner of Police shall be the authority for the issuance of airport security passes. The airport security passes shall be issued on the recommendation of the Director and may be made subject to such conditions as the Commissioner of Police may specify and shall state the areas of the Airport for which the airport security pass is valid.

Section 10

An airport security pass shall be in force for a period of one year or such other period as the Commissioner of Police may determine. The following fees shall be payable for the issuance of new and replacement airport security ,passes

(a}

new airport security pass-

(i)

$10.00 for one year; and

(ii)

$15.00 for two years;

(b)

where an airport security pass is defaced as a result of fair wear and tear, a ·replacement thereof may be issued on payment of a fee of $10.00;

(c)

where an airport security pass is lost or defaced for any reason other than for wear and tear, a replacement thereof may be issued on payment of a fee of $50.00.

Section 11

The Commissioner of Police may at his discretion or on the recommendation of the Director issue a temporary airport vehicle permit, a temporary airport security pass or a visitor airport security pass. For the issuance of a temporary airport security pass or a visitor airport security

;;ass, a person must surrender his national identity card, passport or equivalent identity document.

Section 12

A visitor airport security pass will be issued free of charge. However, for the issue of a temporary airport security pass, the following fees shall apply 711

(a}

a fee of $10.00 shall be payable for a period not exceeding 6 months;

(b)

where a temporary airport security pass is defaced as a result of fair wear and tear, a replacement thereof may be issued on payment of a fee of $10.00;

(c)

where a temporary airport security pass is loss or defaced for any reason other than as a result of fair wear and tear, a replacement thereof may be issued on a payment of a fee of $50.00.

Section 13

The Commissioner of Police may at any time in his discretion cancel any airport vehicle permit or airport security pass without assigning any reason.

Section 14

All vehicles operating within the airside must be road-worthy.

Section 15

All specialised vehicles for aircraft ground support and maintenance must be installed with amber coloured rotating beacon lights.

Section 16

No person shall drive or be in a vehicle within.airside except in those areas for which both his airport security pass and the airport vehicle permit are valid.

Section 17

No person shall interfere with any aircraft or any thing used in connection with any aircraft without lawful authority or reasonable cause or excuse.

Section 18

No person shall enter or climb upon, or attempt tc enter or climb upon, any part of any aircraft without the authority of the person in charge of it or otherwise without lawful authority or reasonable cause or excuse.

Section 19

No person shall enter or get on or attempt to enter or get on any vehicle, truck, trolley or aircraft steps or tamper with any part of its mechanism without lawful authority or reasonable cause or excuse.

Part III

PROVISIONS RELATING TO VEHICLES

AND PERSONS IN MOVEMENT AREA

Section 20

No person shall drive a vehicle at a speed exceeding 25 kilometres per hour in a movement ares.

Section 21

The driver of every vehicle in the movement area shall comply with any direction or verbal instruction given by any authorised officer who is for the time being engaged in the regulation of traffic in the movement area.

Every vehicle in the movement area shall give way to an aircraft at all times and shall give maximum clearance to the aircraft.

Section 23

The person in charge of a vehicle shall not leave the vehicle unattended in the movement area and in the event of a breakdown, he shall immediately inform the Duty Tower Controller and his employer to arrange for the immediate removal of his vehicle. The person in charge of the vehicle shall ensure that aircraft or other vehicles are not obstructed by such breakdown.

Section 24

The driver of a vehicle who desires to proceed to any part of the movement area other than the apron shall obtain prior clearance from the

Duty Tower Controller before proceeding to his destination.

Section 25

Every vehicle which is at the point of entering the manoeuvring area shall stop at the point of entry· to the manoeuvring area and the driver thereof shall first ascertain that there is no aircraft movement before proceeding into the manoeuvring area.

Section 26

The driver. of a vehicle shall not overtake and pass any other vehicle proceeding in the same direction in the movement area.

Section 27

No person shall park a vehicle in or near the movement area or on a vehicular traffic route other than in areas approved for such a purpose.

Section 28

The driver of every vehicle in the movement area shall cause his vehicle to slow down when it is approaching an aircraft which is setting down or taking up passengers.

Section 29

The driver of every vehicle in the movement area shall allow free and uninterrupted passage to every aircraft passenger who is in the movement area and every such passenger shall have precedence over all vehicular traffic.

Section 30

The driver of a vehicle in the movement area which is approaching an aircraft shall cause the vehicle to approach the aircraft at an angle and keep to the right side of the aircraft in order to avoid a collision in the event of any malfunctioning of the brakes of his vehicle.

Section 31

No driver of any vehicle in the movement area shall draw up or stop the vehicle under the wing, tail or fuselage of an aircraft.

Section 32

No driver of any vehicle in the movement area shall start the vehicle when it is within 15 meters of an aircraft which is being refuelled.

The driver of a vehicle in the movement area shall not cause the vehicle to back up to an aircraft except when the vehicle is used for the

Section 34

No vehicle shall approach an aircraft which has its engines running.

Section 35

Every vehicle in the movement area shall keep a safety distance of at least 5 meters from the wing-tip of a stationary aircraft. If travelling parallel to a taxiing aircraft, the vehicle shall maintain a safety distance of at least 40 meters from the edge of the taxiway.

Section 36

The driver of a vehicle proceeding along the runway or taxiway shall in so far as it is practicable keep the vehicle to the right side of the runway or taxiway.

Section 37

No person in charge of a vehicle shall allow it to be on the runway or taxiway unless it is equipped with a two-way radio communication system capable of receiving and transmitting on a designated frequency for communication with the Control Tower. Prior permission must be obtained from the Control Tower for entry into these areas.

Section 38

A vehicle which is not equipped with a two-way radio communication system shall not be permitted on the runway or taxiway but in the event of the vehicle. being allowed in any of these areas, the movement of the vehicle shall be controlled at all times by the use of the following light signals -

(a}

a continuous green light directed at the vehicle on or approaching the runway or taxiway shall authorfse movement on the runway or taxiway;

(b)

a continuous red light directed at the vehicle on or approaching the runway or taxiway indicates that any movement on the runway or taxiway is temporarily prohibited and the vehicle shall stop immediately;

(c)

an intermittent red light indicates that the vehicle must drive clear of the runway or taxiway immediately;

(d)

an intermittent green light indicates that the vehicle which has been ordered to stay clear of the runway or taxiway may return to the runway or taxiway; and

{e)

an intermittent white light indicates that the vehicle is to return at once to its starting point.

Section 39

No person or vehicle shall cross the movement area in front of the path of a taxiing aircraft or an aircraft on tow.

Every person other than a member of a maintenance staff working

Section 42

The person in charge of any equipment or vehicle shall remove the equipment or vehicle from the parking bay and other related parking spaces immediately after the aircraft which they have serviced has taxied away.

Section 43

No person shall leave any refuse or litter on the apron.

Section 44

Every person who is engaged in the work of servicing an aircraft shall inspect the parking bay immediately after the aircraft has been serviced to ensure that no foreign objects or materials are left on the parking bay.

Section 45

No person shall leave or deposit any foreign matter or thing on the surface of the movement area.

Part IV

PROVISIONS RELA'l'ING TO VEHICLES AND

PERSONS IN AIR CARGO BUILDING AREA

Section 47

No person or vehicle shall enter or leave the Air Cargo Building area except through entrance or exit designated by the Director.

Section 48

The driver of every vehicle in the Air Cargo Building shall comply with any direction or verbal instruction given by any authorised officer.

Section 49

Every vehicle and all parts and accessories of such vehicle shall at all times be in such condition and the number of passengers carried by such vehicle, the manner in which any passenger is carried in or on such vehicle, and the weight, distribution, packing and adjustment of the load of such vehicle shall at all times be such that no danger is caused or is likely to be caused to any person in or on the vehicle or on the roads within the Air Cargo Building.

Section 50

The load carried by a vehicle at all times shall be so secured or be in such a position that danger is not likely to be caused to any person by reason of the load or any part thereof falling from the vehicle or by reason of any other movement of the load or any part thereof in relation to the vehicle.

Section 51

If the load carried by a vehicle projects from the rear by more than 2 meters beyond the body of the vehicle, a clean red flag of 300 millimeter square shall be displayed unfurled at a point not more than 0.3 meter from the extreme projecting point at the rear of the load so as to be clearly visible from the rear of the vehicle in the daytime.

Section 52

Except with the permission of the Director, no part of a load or any covering of such load on a vehicle shall-

(a)

trail along the road;

(b)

cause or likely to cause danger or obstruction or annoyance to other road users;

(c)

project in front of the vehicle; or

(d)

project laterally beyond the body or wheels of the vehicle or any authorised fittings permanently attached to the vehicle.

No person shall leave any refuse or litter at and in the Air Cargo

Building.

PARTV

PROVISIONS RELATING TO PERSONS AND

Section 54

VEHICLES IN THE AIRPORT

No person shall interfere with, or misuse, or attempt to interfere with, or misuse, any lift, escalator, baggage conveyor, aerobridge, or any mechanical, electrical or electronics apparatus without lawful authority or reasonable cause or excuse.

Section 55

No person shall, except in the case of an emergency, intentionally operate, or attempt to operate, any switch or lever of any escalator, lift or any other automatic conveyance for passengers, goods or baggage.

Section 56

No person shall organise or take part in any demonstration, procession or public assembly likely to obstruct or interfere with the proper use of the Airport or obstruct or interfere with the comfort and convenience or safety of passengers or persons using the Airport.

No person shaH display any flags, banners or emblems likely to cause a breach of the peace at the Airport.

Section 58

No person shall deposit or leave refuse or litter at the Airport except in or by receptacles provided.

Section 59

No person shall affix bills, posters or stickers upon any wall, structure or floor of the Passenger Terminal Building or any part of the

Airport.

Section 60

No person shall remain within the Airport, after having been requested by an authorised officer or by a police officer to leave.

Section 61

No person shall erect or use any apparatus for transmission or amplification of sound, speech or images without permission from the

Director.

Section 62

No person shall sell or distribute anything, offer anything for sale or hire or make any offer of services, without obtaining a permit or licence to do so from th~ proper authority and the Director's permission, within the perimeters of the Airport.

Section 63

No person shall distribute or display signs, advertisements, circulars or other printed or written matter without permission from the Director.

No person shall cause or permit a vehicle to wait in a no waiting area.

Section 65

Taxis shall be parked in the taxi pick-up area.

No taxi shall pick-up a passenger in front of the Passenger Terminal

Building except from a taxi pick-up area.

Section 67

No vehicle other than a taxi shall be parked in a taxi pick-up area.

Section 68

Vehicles other than taxis shall be parked in the designated car parks in such a way as not to cause an obstruction.

Section 69

If any vehicle is illegally parked at any place in the Airport, the

Director or Commissioner of Police may cause the vehicle to be removed and the owner or driver thereof shall pay the costs or charges for the removal of that vehicle.

Part VI

MISCELLANEOUS PROVISIONS

Section 71

The Director may designate any part of the Airport as a parking place for vehicles any may impose such conditions and charges as he considers fit. No person who parks a vehicle at the parking place shall hold the

Director responsible for any loss or damage caused to the vehicle or its contents, whilst parked in that parking place.

Section 72

No person shall park a vehicle or cause or permit a vehicle to remain at rest at any place in the Airport in any position or in any condition or any circumstances as to be likely to cause danger, obstruction or undue inconvenience to other users of the Airport or to traffic within the Airport.

Section 73

Every person on the premises of the Airport shall obey the lawful directions given by an authorised officer.

Section 74

No person shall smoke or bring a naked light into or light any naked light in any place of the Airport where any such act is prohibited by notice.

Section 75

No person shall operate or use any radio transmitter or other device capable of radiating electrical interference, in such a way as to prejudice, or be likely to prejudice, the operation of any communications or navigation systems at the Airport.

Section 76

No person shall allow any vehicle, animal or thing to be on the

Airport or any part thereof after its presence on the Airport has been forbidden by an authorised officer or a police officer.

Section 77

No person shall intentionally obstruct or interfere with the proper use of the Airport or with any person acting in the execution of his duty in relation to the operation of the Airport, including the conveyance of passengers, their baggage and other goods, and the maintenance and servicing of the Airport or vehicles or aircraft on it.
